Tennessee Child Custody Laws

Tennessee child custody will be determined based upon the best interests of the child. The child�s preference is a factor that the Court will consider.

While there is no preference regarding the sex of either parent in determining custody, if the child is of tender years, the sex of the parent seeking custody is a factor that may be considered. If the parties have agreed to share joint custody, a Tennessee Court will presume that such an arrangement is in the child�s best interests. However, if there is a history of domestic violence, the Court will presume that joint custody is not in the child�s best interests.
